Terms and Conditions

1. Scope

These are the terms and conditions of sale which apply to all goods sold by the seller of the website www.spiru4.me under the operation of GFOOD Asia Co., Ltd. to the customer. These terms and conditions shall take precedence over any terms and conditions which may be contained in the customer’s order or other documentation may be altered with the express written agreement of the seller.

Definition

Customer:
means the customer reflected on the order form applied through the website www.spiru4.me;

Seller:
means GFOOD Asia Co., Ltd Business Registration and VAT No. 0835559000534; hereinafter called as “ GFOOD Asia

Goods:
means the goods described in the order form;

Order form:
means the order form to which made through the website www.spiru4.me and terms and conditions are attached;

The act of placing an order implies that the Customer accepts these General Terms & Conditions of Sale, completely and without any reservations. No agreement or commitment, without the formal written acceptance of GFOOD Asia, may prevail over these Terms & Conditions of Sale. Any contrary clause put forward by the Customer shall, in the absence of express acceptance by GFOOD Asia, be unenforceable against GFOOD Asia, regardless of when it may have become aware of such clause put forward by the Customer..

2. Prices

Prices shown are in THB (thai Bath) and are inclusive of all taxes in the sending country, excluding shipping costs. They may be subject to modifications. The items ordered are billed on the basis of the price in force at the time the order is registered.
The price is payable at the time of the order, in full and in a single payment. All orders are billed in THB (thai Bath) and payable in THB (thai Bath). For deliveries outside Thailand, any customs fees or local taxes remain the responsibility of the recipient.

3.  Orders

Orders may be made on the website www.spiru4.me.
The contractual information is presented in English or Thai and acceptance will be confirmed, at the latest, at the moment your order is validated.

GFOOD Asia
reserves the rights to not register a payment and/or to not confirm an order for any reason, particularly in the event of a supply problem or any difficulty relating to the order received.

4. Shipping charges

Shipping charges include a flat fee for the costs of handling and shipping. They are the Customer’s responsibility and are billed at the end of the order process, added to the costs of the products being purchased.

5. Payment

The Customer may pay for his or her order:

  • by credit card via Paypal
  • by Paypal
  • By Cash on delivery
  • By Bank Transfer

6. Order processing

Spiru4 Fresh Spirulina

Delivering Monday and Friday
In the event of a delay in preparing an order, the Customer will be notified via email. In such an event, and as long as the order has not yet been shipped, the Customer will be able to cancel the order and be reimbursed in full.

Spiru4 Spirulina Tablets, Sachets

From Monday to Saturday, orders placed before 14:00 are processed and shipped on the same day, while orders placed after 14:00 are processed on the following day. In the event of a delay in preparing an order, the Customer will be notified via email. In such an event, and as long as the order has not yet been shipped, the Customer will be able to cancel the order and be reimbursed in full.

7. Retractation / Guarantee

No questions asked and 100% money back

If you are not happy with our product, please assemble them in the original packaging, the boxes, jars, sachets or others containers and return to us also please be aware at least 51% of your first opened box product shall not be used.
For example: If you have to return sachet product you shall return unopened minimum 16 sachets (the original box contains 30 sachets).

How we return ?

  • Wrap up your unwanted product and follow instructions.
  • Contact us to get your returning Authorization code (RAC)
  • Download the Returning and Refund initiation form (www.spiru4.me/refund). Fill details and send back to us
  • Ship back the package and wait for your refund.

We will reserve the return policy if :

  • We inspect all returned items are fraud.
  • The purchased merchandise is more than 30 days after delivery
  • more than 50% of the first opened box is consumed or damaged (Fresh, Tablet, Sachet).
  • The product is not in their original packaging or the other unopened packages missing or are not sealed in original condition.
  • The packages and product damages resulting from customer misuse, abuse, water, after receiving the purchased goods.

Other notes

  • You shall pay for the guarantee postage to ensure the loss and damages during delivery to us.
  • Your refund will be processed within 14 days after we received the returned item(s) and all in the conditions of merchandise.
  • The Returning and Refund initiationform shall be attached with your returning items with a valid RAC (Returning Authorization Code)

Returns Due to Our Error…We will make it right by:

  • Sending you a replacement products without condition. We will cover the cost or any return shipping.
  • If you change your mind and would like to get your purchase back we are please to receive and if the returning product is no defective and also the refund policy will be issued for you.

8. Rejection / Cancellation

We may cancel an order if the Goods are not available for any reason. We will notify you via phone number or email address provided. The refund process will take approximately 5-7 business days and can show up within 1-2 billing cycling depending on your bank processing time.

Once the order has been created, paid or shipped for, you will not be able to cancel the order if you change your mind.

9. Availability

GFOOD Asia products are offered as long as they are shown on the website www.spiru4.me. In the event that products become unavailable after the Customer’s order has been placed, GFOOD Asia will inform the customer via email. The Customer’s order will be automatically cancelled, and no bank debit will be made.

10. Complaints

All complaints or requests for exchanges or refunds must be submitted to the email address hotline@spiru4.me or by phone at +66 (0)2 821 52 22 within a period of 30 days after delivery.

The products must be returned to GFOOD Asia in the state in which the Customer received them, including all of their elements (e.g., accessories, packaging, usage instructions, etc.) The shipping costs will be refunded to the Customer on the basis of the price billed, and the return costs will be refunded upon presentation of receipts.

11. Liability

GFOOD Asia cannot be held liable for damages resulting from improper usage of any purchased product.
Additionally, GFOOD Asia cannot be held liable for any inconvenience or damage relating to the use of its website(s), such as a disruption in service, a third-party intrusion, or the presence of computer viruses.

12. Transfer of ownership / transfer of risk

The transfer of ownership of the products in favor of the Customer shall happen only after the price has been paid in full by the Customer, regardless of the date of delivery of the products in question. On the other hand, the transfer of risk of loss or spoilage of the products shall happen upon receipt by the Customer of the products in question.

13. Governing Law & Jurisdiction

The language of the present contract is English. These terms and conditions of sale are subject to Thailand law. In the event of a dispute, the courts of Thailand shall have exclusive jurisdiction.

14. Intellectual property

All elements of the website www.spiru4.me are and remain the exclusive intellectual property of GFOOD Asia. No one is authorized to reproduce, redistribute, or otherwise make use of any element of the site, be it software, visual, or audio, for any purpose, in whole or in part. Any simple or hypertext link is strictly forbidden without the express written consent of GFOOD Asia.

15. Personal data

GFOOD Asia reserves the right to collect personal data and information regarding website users. These data and information are necessary for managing each Customer’s order, as well as for improving the services and information that we offer our users. They may also be transmitted to companies that contribute to these relationships, as well as to those responsible for carrying out services and orders, for purposes of management, execution, processing, and payment.
These data and information are also kept for security purposes, in order to comply with legal and regulatory requirements.
Customers have rights to access, correct, and contest any personal data and information that relates to them, directly on the website.

16. Records

GFOOD Asia will keep records of purchase orders and bills on a reliable and durable medium, representing faithful copies under the General Data Protection Regulation (GDPR).

GFOOD Asia’s computerized records are hereby considered by all concerned parties to be evidence of the communications, orders, payments, and transactions between the parties.
